JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.13183/2022, for the offences punishable under Sections 498A, 506, 504 and 323 of the IPC and under Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Jayantha Poojary, learned counsel appearing for the petitioner, Sri. Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Sri. Rajesh Shettigar, - 3 - HC-KAR NC: 2026:KHC:9056 CRL.P No. 213 of 2025 learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.2156/2022 and have settled the dispute amongst themselves before the Family Court in terms of settlement and also they have filed the Compounding Application along with joint affidavit before this Court seeking closure of the proceedings. The joint affidavit reads as follows: "JOINT AFFIDAVIT WE, 1) Krishna Kishore Kalluri, S/o Late K.S. Prakash, Aged about 39 years, R/at. No.688, 10th A Main, Jayanagar, 4th Block, Bengaluru South, Bengaluru- 560011 2) Smt. R.D.M. Priyadarshini, W/o. Krishna Kishore Kalluri, Aged about 38 years, R/a. Door No. 50, C Street Fort, Near Vani Vilas Hospital, Bengaluru-560002, do hereby solemnly affirm and state as follows: 1. We are the petitioner and respondent No. 2 (Defacto Complainant) in the above petition. We know the facts of the case. 2. We state that the respondent No.2 has lodged a complaint dated 29.09.2021 before the respondent No.1 police against the petitioner and his mother and sister which came to be registered as Crime No.179/2021 and subsequently the 1st respondent police have filed chargesheet against the petitioner in CC No. 13183/2022 pending on the file of 37th ACMM At Bangalore by the respondent No.1, for the offences punishable under sections 498A, 506, 504 and 323 of IPC and Section 3 and 4 of DP Act. Petitioner is the husband of the 2nd respondent. - 4 - HC-KAR NC: 2026:KHC:9056 CRL.P No. 213 of 2025 3. We state that subsequent to filling of said complaint the 2nd respondent filed MC No. 2156/2022 for divorce against the petitioner before the 1st Additional Family Court At Bangalore. The petitioner and 2nd respondent submit that at the intervention of well-wishers and family members, filed joint memo before the family court and reunite the family and agreed to withdraw all the pending cases each others as per the terms mentioned In the joint memo. The copy of the joint memo filed before family court in MC No. 2156/2022 is enclosed along with this application. 4. We state that there has been a lot of changes in the circumstances from the date on which the complaint was filed to this day and the circumstances now warrant that the respondent No. 2 and petitioner lead a happy married life with the permission of this hon'ble court. 5.We state that there is no coercion or compulsion on 2nd respondent to compound the offences and on her own free will agreed to compound the case. Hence this application seeking kind permission of this hon'ble court to compound the offences. Wherefore, this hon'ble court be pleased to allow the accompanying application in the interest of justice. What is stated above all are true and correct to the best of our knowledge, belief and information." 4. In the light of the Compound Application and Joint Affidavit being filed as afore-quoted and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. - 5 - HC-KAR NC: 2026:KHC:9056 CRL.P No. 213 of 2025 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.13183/2022 pending before the 37th Addl.
