The present writ petition has been filed under Article 226/227 of the Constitution of India with a prayer for issuance of an appropriate writ or order in the nature of mandamus directing the respondent No.1/Punishing Authority to stop the deduction @ 25% per month from the pension of the petitioner till the pendency of the statutory appeal dated 14.03.2026 (Annexure P-2) filed by the petitioner against the order dated 20.02.2026 (Annexure P-1) issued under endorsement dated 23.02.2026 passed by respondent No.1, whereby cut in the pension @ 25% for 5 years has been imposed on the petitioner. 20.02.2026(Annexure P-1) till the respondent No.2/Appellate Authority of the respondent-Corporation decide the statutory appeal dated 14.03.2026 (Annexure P-2) filed by the petitioner.

Learned counsel for the petitioner submits that at this stage, he will be satisfied if a direction is issued to the respondents/competent authority to decide the statutory appeal dated 14.03.2026 (Annexure P-2) of the petitioner by passing a speaking order in a time bound manner. He further prays that till final disposal of the aforesaid statutory appeal, recovery from the pension of petitioner may be stayed.

Ms. Shivani Sharma, Advocate accepts notice on behalf of the respondents. She submits that she had no objection in case a direction is issued to respondents/competent authority to hear and decide the statutory appeals of the petitioner dated 14.03.2026 (Annexure P-2) in a time bound manner.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, without commenting upon merits of the case, present petition is disposed of and the respondents/competent authority are

P-2) in a time bound manner and pass a speaking order, within a period of 03 months from the date of receiving a certified copy of this order.

Since the statutory appeal is still pending and yet to be decide, it would be in the interest of justice that no further recovery will be effected from the petitioner till the disposal of the appeal.
