08/04/2026 D/L – 65 Court No.28 S. Kundu Allowed C.R.M.(A) 735 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Kaliachak P.S case no. 1514 of 2025 dated 29/08/2025 under Sections 3 and 4 of the Explosive Substances Act, 1908. In the matter of: Yakub Sk & Anr. ...Petitioners. Mr. Wasim Akram Mr. M. S. Islam …for the petitioners. Mr. Binay Kr. Panda Md. Ejaj Akhter …for the State. 1. Report filed on behalf of the State is taken on record. 2. Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case. Some other similarly circumstanced co- accused were granted anticipatory bail by this Court in CRM (A) 37 of 2026, CRM (A) 3773 of 2025 and CRM (A) 4398 of 2025. 3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that the explosive substances were recovered from a mango garden and some burnt articles were seized from the place of occurrence. On merits, the only material available against the petitioners is the statement of the co-accused. However, the petitioner no. 1 has some criminal antecedents. Moreover, this Court was earlier 2 pleased to reject the prayer for anticipatory bail of one Ishak Khan. 4. It appears that the name of the co-accused Ishak Khan was taken by certain independent eye-witnesses in their statements present at pages 17 and 18 of the case diary. But the petitioners have not been named there. 5. In view of the above, considering the other materials available in the case diary, in view of the fact that earlier similarly circumstanced co-accused were granted anticipatory bail by this Court and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the petitioners. 6. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate the witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court. 7. Accordingly, the application for anticipatory bail is allowed. 8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
