The present Contempt petition has been filed in pursuance of the order of this Court passed in W.P.No.34132 of 2021 dated 12.11.2021, in and by which, this Court has directed the 4th respondent to conduct survey in R.S.No.97/1, Koothampoondi Village, Anthiyur Taluk, Erode District. 2. In the Contempt Petition, the Commissioner was appointed and the Commissioner has filed a report wherein he has referred that certain areas of the temple property are encroached upon as cart track, coconut trees and sugarcane cultivation and grass for cattle feed. While looking at the order of this Court, there was a direction to remove the encroachments ,whereas the encroachment appears to be by way of cart track, by planting coconut trees and sugarcane. Since the coconut trees and sugarcane are in the temple property, the temple authorities are directed to take over those coconut trees and the sugarcane cultivation. 3. If at all there is any other encroachments, it is for the temple authorities to initiate all appropriate action to evict the encroachers and to protect the temple property. It is also relevant to mention here that the subject property is classified as Sarkar promboke. In view of the same, we do not find any wilful disobedience of the order passed by this Court.
