JUSTICE ASHOK KUMAR JAIN Order 05/05/2026 1. Instant miscellaneous applications for recalling order dated 09.02.2026 passed by this Court in S.B. Learned counsel for the petitioners submits that Hon’ble Court has disposed of the writ petition on the basis of ratio laid down in case of Vikram Singh and Anr. vs. State of Rajasthan and others, S.B. Civil Writ Petition No. 16275/2023, but same is not applicable in the instant case. He also submitted that the order is required to be recalled and matter be placed for regular hearing as the matter requires consideration on merits. 3. Aforesaid contentions were opposed by learned counsel for respondents and submitted that the impugned order is passed on the basis of consent of the counsel for the applicants. 4. Heard learned counsel for the parties and perused the material placed on record. 5. S.B. Civil Writ Petition No. 15838/2023 was disposed of on 09.02.2026, and the order itself indicates that counsel for petitioners had placed reliance upon judgment in case of Vikram Singh and Anr. vs. State of Rajasthan and others (supra), and on the basis of said judgment, the writ petition was disposed of. Relevant paragraphs from the said order are reproduced as under: 2. Learned counsel for petitioners while referring judgment dated 20.10.2023 in case of Vikram Singh and Anr. Vs. State of Rajasthan & Ors.: S.B. Civil Writ No.16275/2023 and connected matters submitted that clause in the order of appointment restricting the relieving of the petitioner(s) was quashed and set aside. He further submits that the judgment is approved [2026:RJ-JP:19331] (8 of 9) [WMAP-148/2026] by Hon’ble Division Bench on 05.03.2024 in D.B. Special Appeal Writ No.53/2024. He further submits that the writ petition be disposed of in accordance with judgment in case of Vikram Singh & Anr. Vs. State of Rajasthan (supra). 3. Mr. Manoj Sharma, AAG accepts notice on behalf of respondents and office is directed to reflect the name of Mr. Manoj Sharma, AAG as counsel for respondents. 4. Mr. Manoj Sharma, AAG submits that the judgment in case of Vikram Singh & Anr. Vs. State of Rajasthan (supra) has attained finality and same has been implemented by the respondents. He submits that if the judgment is applicable on facts and circumstances of the case then the writ be disposed accordingly. 5. Having considered submission of learned counsel for the parties and also considering the material as placed on record, the writ petition preferred by petitioners is disposed of in terms of order dated 20.10.2023 in S.B. Civil Writ Petition No.16275/2023 Vikram Singh & Anr. Vs. State of Rajasthan & Ors. The clause in appointment order placing a restriction to relieve the petitioners is hereby quashed and set aside. 6. The material on record indicated that learned counsel for petitioners themselves had relied upon the order cited by them and on the basis of their submissions, the writ petition was disposed of, therefore, there is no ground to recall the order hence, recalling application is not maintainable when [2026:RJ-JP:19331] (9 of 9) [WMAP-148/2026] the order is passed at the instance of learned counsel for petitioners, who was present on the date of passing of order. 7. Therefore, the recalling application lacks merits and same is liable to be dismissed. 8. In view of discussion made hereinabove, the instant recalling application is hereby dismissed.
