FAKIRGANJDISTRICT DHUBRI ASSAM PIN783330 ------------ Advocate for : MR. SURAJIT DAS Advocate for : GA ASSAM appearing for THE STATE OF ASSAM BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 03.06.2026 Heard Mr. A. Mishra, learned counsel for the petitioner and Mr. H. Sarma, learned State Counsel for the respondent No. 3. This is an application praying for impleadment of Sri Rofiqul Islam, son of Chan Miya of Birshing Part-III village, P.O & P.S.-Fakirganj, Dhubri, as party respondent in WP(C) 2186/2026. The petitioner filed the connected writ petition assailing the rejection of the election petition with regard to the challenge to the election of the respondent No. 6, namely, Asma Khatun. The party sought to be impleaded had filed a caveat in the connected writ petition who was a party in the election petition. This Court on 24.04.2026 while issuing notice in the connected writ petition has directed the applicant/writ petitioner to file appropriate application for impleadment of caveator, who was a party in the election petition. Page No.# 3/3 Considering the fact that the party sought to be impleaded was a party in the election petition and also considering the fact that this Court had already directed the applicant/writ petitioner to file an application for impleadment of the caveator, I deem it proper to allow this application. Accordingly, Sri Rofiqul Islam is allowed to implead as respondent No. 7 in the connected writ petition. Interlocutory application is, accordingly, allowed and disposed of. JUDGE Comparing Assistant
