Mr. Saket Kumar, A.P.P. ------ Order No.02 / Dated : 08.01.2026 Bail petition filed on behalf of the petitioner- Golu @ Tarun Sharma, who is in custody since 18.10.2025 in connection with Sakchi P.S. Case No. 169 of 2025 for the offence registered under Section 65(1), 61(2), 75(2), 351 (2), of the Bhartiya Nyaya Sanhita, 2023 and Section 4(2)/8 of POCSO Act pending in the Court of learned Special Judge, POCSO at Jamshedpur, is pressed into motion. Both the victim girls are neighbors and the informant of the case is mother of one of them. As per the FIR, both had gone missing from home since morning on 16.10.2025 and they had returned on the same day. It was disclosed by the victim girls that they had been taken by their friends Shreyansh and Karan on their motorcycles to Doremon Hotel in Room Nos.504 and 506. It is alleged that physical relationship was established by Shreyansh and Karan after administering liquor to them. It is argued by the learned counsel on behalf of petitioner that there is no allegation of kidnapping or sexual assault against the present petitioner and he has been named in this case only because he was serving as a Waiter in the said hotel and had no role in the offence. This has come in the FIR itself, wherein it has been stated that liquor and chicken were brought by this petitioner, who was serving as a staff in the said hotel. Learned A.P.P. opposed the bail petition. It is submitted that there is allegation in the FIR of forcibly administering liquor to the victim girl by this petitioner. Having considered the submissions advanced, the main allegation of sexual assault is against the other co-accused. Under the circumstance, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
