Mr. Ejaz Hossain ..for the petitioners Mr. Amal Kumar Sen Mr. Lal Mohan Basu ..for the State Learned counsel for the petitioners submits that the that the private respondents have been raising construction by encroaching upon a portion of the panchayat road, without obtaining sanctioned plan and without conversion of the land. The petitioners submitted several representations before the concerned authority in this regard but to no effect. The petitioners seek consideration of the representations. Upon consideration of the submission made on behalf of the parties, this Court directs the Pradhan, Chandanpur Gram Panchayat, being the 3rd respondent herein to consider and dispose of the representations submitted by the petitioners dated March 31, 2023, June 26, 2023 and January 31, 2024 respectively within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/ unauthorized, the concerned authority shall take necessary steps, in accordance with law. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
