Learned advocate appearing for the petitioner submits that the petitioner is in custody for 6 months 19 days, charge-sheet has been submitted and charges have been framed, as such, the petitioner may be released on bail. Additionally, it has been submitted that the victim is more than 17 years and she was in a relationship, as such, the accusation of any forcibly taken away the girl do not arise. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS as also the other materials on record. Having considered that the evidence of the victim is yet to commence, I am not inclined to release the petitioner on bail at this 2 stage. Petitioner would be at liberty to approach this Court after the evidence of the victim is over. Accordingly, CRM(M)493 of 2026 is rejected at this stage.
