Mr. Vivekananda Bose Ms. Subhra Nag …for the State. Affidavit of service filed by the petitioner is taken on record. None appears for the Panchayat despite service. Learned counsel for the petitioner submits that the petitioner participated in an e-tender issued by the Pradhan, Kantanagar Gram Panchayat and complied with all the terms and conditions as well as eligibility criteria as laid down in the bid documents. After the bid was opened, it was found that the petitioner’s bid was rejected for not depositing the employees’ provident fund. Learned counsel submits that the said amount was deposited by the petitioner within due time which has not been considered by the authority. The petitioner submitted a representation in this regard before the concerned authority on 16th February, 2026 followed by a demand notice on 18th February, 2026 and seeks consideration of the same. 2 Upon consideration of the submission made on behalf of the parties, the Pradhan, Kantanagar Gram Panchayat,, being the 4th respondent herein, is directed to consider and dispose of the representation as well as the demand notice filed by the petitioner within six weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the concerned authority decides the issue in favour of the petitioner, necessary consequential steps be taken at the earliest. The authority shall not proceed with the tender in question till disposal of the representation. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
