Item- 24. sg 30-03-2026 Ct. 19 WPA 7384 of 2026 Samaresh Bera & Ors. Versus State of West Bengal & Ors. Mr. Dinesh Pani Ms. Subagna Sen …for the petitioners Ms. Anjusri Mukherjee Mr. Kinkar Kr. Bhattacharyya …for the State The petitioners allege that the respondent authorities have not considered their prayer for grant of short term lease. Record reveals that a proceeding has been initiated by the Sub-Divisional Magistrate under the provisions of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962. From the materials disclosed in the writ petition, it appears that the hearing was fixed on 24th March, 2026. The learned Advocate appearing for the petitioners submits that the petitioners duly attended the hearing fixed on 24th March, 2026 and made submission with regard to grant of short term lease in course of hearing before such authority. Since a proceeding has been imitated and it is case of the petitioners that the petitoiners have prayed for grant of short term lease before such authority, this Court is of the considered view that interest of justice would be sub-served if the authority communicates its decision of the hearing that took place on 24th March, 2026 to the petitioners. The Sub-Divisional Magistrate, Tamluk, Purba Medinipur, being the third respondent, is directed to communicate the decision of the hearing that was conducted on 24th March, 2026 to the petitioners as expeditiously as possible. 2 In case, the said respondent authority is of the view that a further hearing is necessary, it will be open to such authority to communicate the next date of hearing to the petitioners and to pass a reasoned order thereafter in accordance with law as expeditiously as possible. With the above observations and directions, WPA 7384 of 2026 stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Hiranmay Bhattacharyya, J.)
