The applicant has preferred this application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.224/2022, registered at Police Station Lormi, Distt. Mungeli, for the offence punishable under Section 20 (B) of the Narcotic Drugs & Psychotropic Substances Act, 1985. Case of the prosecution, in brief, is that upon receiving secret information, the Police seized 2 kg of contraband (Ganja) from the vehicle Mahindra XUV 500 bearing registration No.OD-02/DO-0023 in which 3 co-accused persons namely, Sarthi Nag, Ramnachal Bagh and Gulab Bhoi were travelling. 3. Mr. Rishi Rahul Soni, learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated. Only because one agreement to sell dated 11.1.2022 has been seized which appears to have been executed between Manas Ranjan Jena and the present applicant and thereby suspected vehicle was sold by Manas Ranjan Jena to the present applicant, offence has been registered against him. The vehicle has been obtained on Supurdnama by order dated 15.12.2022. Consequently, the said vehicle was delivered to Anjali Das on 23.12.2022. Moreover, co-accused namely, Devnath Sahu has already been granted anticipatory bail vide order dated 15.11.2022 passed in MCRCA No.1304/2022. Therefore, anticipatory bail may be granted to the present applicant also. 4. On the other hand, Mr. Rahul Tamaskar, learned State counsel opposes the bail application and submits that challan has already been filed in the year 2022 and the applicant is not cooperating with the investigation. 5. I have heard learned counsel for the parties and considered their rival submissions made herein-above and also went through the documents annexed with the bail application. 6. Having heard learned counsel for the parties and having regard to the facts and circumstances of the case, particularly the fact that as per the 3 order of Supurdnama, Anjali Das is the registered owner of the vehicle since 14th March, 2022, and she obtained the said vehicle on Supurdnama by order dated 15.12.2022 passed by the competent jurisdictional Court and no contraband was seized from possession of the present applicant, I am of the opinion that present is a fit case in which the applicant can be granted privilege of anticipatory bail. Accordingly, the Application is allowed. 7. Accordingly, it is directed that in the event of arrest of the applicant in connection with the aforesaid offence, he shall be released on anticipatory bail by the officer arresting him on his executing a personal bond in the sum of Rs.1,00,000/- with one surety in the like sum to the satisfaction of the concerned investigating / arresting officer. The applicant shall also abide by the following conditions: - 1. He shall make himself available for interrogation before the concerned arresting / investigating officer as and when required. 2. He shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer. 3. He shall not act, in any manner, which will be prejudicial to fair and expeditious trial. 4. He shall not involve himself in any offence of similar nature in future. Sd/- (Sanjay K.
