2. The prayer in this petition has been made for quashing of the order taking cognizance as well as the entire criminal proceeding initiated against the petitioner in connection with RC Case No.12(s) 2016 EOVIR registered under sections 120B read with section 420, 409, 471 of the IPC pending in the court of learned Special Judicial Magistrate, Ranchi.
3. Mr. Shiv Shankar Jee, the learned counsel appearing for the petitioner submits that he is associate of Mr. Prakash Chandra Roy, the
learned counsel for the petitioner and from the office of Mr. Prakash Chandra Roy, the learned counsel, the petitioner has taken the No Objection Certificate and in view of that he submits that his office is not in a position to argue the matter. He next submits that the NOC has already been taken one month before.
4. Mr. Prashant Pallav, the learned counsel for the CBI is present.
4. This petition is still pending and the petitioner has taken No Objection Certificate from the office of Mr. Prakash Chandra Roy, the
learned counsel, and if such a situation is there, it was incumbent upon the petitioner to make alternative arrangement, either appointing another Advocate to pursue his case or to appear in-person. But, the petitioner has not taken any such step, which prima-facie suggest that petitioner has lost interest in the matter. As such, this petition is, hereby, dismissed.
