ORDER 01.06.2026
Heard Mr. A Khanikar, learned counsel for the petitioner. Also heard Mr. J Handique, learned Standing Counsel, Revenue Department. 2] The petitioner before this Court is aggrieved by non-consideration of his request for transfer from Kampur Revenue Circle to any other Revenue Circle within the district of Nagaon. The ground and reason ventilated by the petitioner is that his son and daughter are stated to be intellectually disabled. It is submitted that the petitioner had initially submitted a joint representation along with another employee seeking a mutual transfer. However, the said representation was not acted upon. Subsequently, the employee with whom the petitioner had sought mutual transfer was transferred and posted elsewhere, whereas the petitioner's case was not considered and his claim was overlooked. Thereafter, by representations dated 26.09.2025 and 12.02.2026 he had again approached the Authority for his transfer citing the grounds mentioned therein. It is submitted that the representation dated 26.09.2025 is presently pending
Page No.# 3/3 before the District Commissioner (Revenue) in the district of Nagaon. 3] At this stage considering the limited prayer made before this Court, this Court is of the view that the writ petition can be disposed of with a direction to the District Commissioner (Revenue), Nagaon to expeditiously consider and dispose of the representation dated 26.09.2025 filed by the petitioner praying for consideration of his prayer for transfer. Accordingly, it is directed that the said representation will be disposed of by the District Commissioner (Revenue), Nagaon within a period of 3 (three) weeks from the date of receipt of the certified copy of this order. It is made clear that although the writ petition is
disposed of, there is no opinion expressed by the Court on the merit of the case. 4] In terms of the above the writ petition stands disposed of.
