Building Rules, 2017, besides being violative of Article 14 and 300-A of Constitution of India and consequently direct the 2nd Respondent herein to conduct a detailed survey by demarcating the Petitioners property situated in Sy. No. 170/1, Venugopal Nagar Extension, Anantapuramu, A.P by considering Petitioner's representation dated.26.03.2026 in accordance with law and to restrain the 3rd Respondent from interfering with the Petitioners peaceful possession of the subject property or from carrying on any construction in subject property and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to suspend the Building Permission issued by the 2nd Respondent 2 herein in favour of the 3rd Respondent herein and to direct the 2nd Respondent herein to conduct an detailed survey and to demarcate the boundaries of the Petitioner’s land situated in Sy.No. 170/1 by considering the Petitioner’s representation dt.26.03.2026 and pass IA NO: 2 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the 3rd Respondent herein not to make any construction activity in the Petitioner’s property situated in Sy.No. 170/1 and pass Counsel for the Petitioner: 1. The petitioner filed the present writ petition aggrieved by the inaction on the part of respondent No.2 in considering the representation dated 26.06.2026 submitted by the petitioner against the unauthorized construction allegedly undertaken by respondent No.3 in Survey No.170/1 of Venugopal Nagar Extension, Ananthapuram. 2. The learned counsel appearing for the petitioner submits that the notice sent to respondent No.3 was returned un-served with an endorsement that no such person was available at the said address. 3. Today, when the matter is taken up for hearing, the learned Standing Counsel appearing for respondent No.2 has filed the written instructions. It is stated therein that, pursuant to the representation received from the petitioner, a field inspection was conducted and the survey was carried out by the Town Planning Officer. As per the written instructions, the subject construction undertaken by respondent No.3 falls in Survey No.170/2 and not in Survey No.170/1. A copy of the survey report is also placed before the Court. It is further stated in the instructions that respondent No.3 has constructed the subject structure strictly in accordance with the survey records and after obtaining the requisite permission from respondent No.2. 4. In view of the instructions received and the survey report placed before this Court, no further orders need be passed in the writ petition. 4 However, it is left open to the petitioner to approach the appropriate forum in the event of any dispute with regard to the title over the subject property. 5. Accordingly, the writ petition is closed. There shall be no order as to costs.
