4. The present applicant-Vijay Kumar Pandey, S/o Dhaneshwar Kumar is praying for regular bail in reference to first information report dated 01.06.2025 bearing FIR No.0059 of 2025, P.S. Selaqui, District Dehradun wherein as many as three persons, namely, Santosh Kumar, Akshay and Rajendra Chaudhary were implicated for the offences punishable under Section 318(4), 336(2), 336(3), 338, 340(2), 61(2), 111 of BNS, 2023 and Section 63 and 65 of the Copy Right Act, 1957 and Section 66(C), 66 (D) of Information Technology Act.
5. It is argued by learned counsel for the applicant that applicant is innocent and has been falsely implicated; he is languishing in jail since 21.08.2025 and he has no criminal antecedents; the

2026:UHC:5067 charge sheet has already been filed on 25.10.2025 and the trial has been commenced. It is argued that as many as six co-accused persons have already been granted bail by the trial court. He submits that with similar nature of allegations in different States, FIR was lodged against the applicant, however in those cases the applicants have already been enlarged on bail. He submits that since the present applicant is languishing in jail since last more than 9 months and the trial has already been commenced, therefore, the applicant be released on bail particularly keeping in view the fact that as many as six other co-accused persons have been enlarged on bail by the trial court.
6. On the other hand learned AGA have not disputed that other six co- accused persons have already been enlarged on bail and the trial has already been commenced.

Mr. Lalit Sharma, learned counsel for the victim submits that the allegations are very serious in nature and not only this, the applicant and other co-accused are indulged in such activities in other States also and this is an organized crime as such the offence punishable under Section 111 of the BNS, 2023 is made out, however, he has also not disputed that other co-accused persons have already been enlarged on bail and the trial has already been commenced.
8. After hearing the learned counsel for the parties and taking into
consideration that some of the co-

2026:UHC:5067 accused person have already been enlarged on bail by the trial court and this fact has not been disputed by learned AGA as well as by learned counsel for the victim and furthermore the present applicant is languishing in jail since more than 9 months and trial has already been commenced, therefore, this Court is of the view that applicant deserves for bail.
9. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
10. Let the applicant- Vijay Kumar Pandey, S/o Dhaneshwar Kumar, be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions:-
(i) Applicant shall not leave the country without leave of the Court and shall surrender his passport to the concerned court. (ii) He shall not indulge in any such similar activity in future either in this State or in other State. (iii) He shall not make any attempt to influence the witnesses or to temper the evidence.
