Learned advocate appearing for the petitioner submits that petitioner is in custody for more than a year. Learned advocate for the de-facto complainant is present and opposes the prayer for bail. Learned advocate for the State produces the Case Diary. I have taken into account the statement of the victim under Section 164 of Cr.P.C. and having considered the period of detention of the present petitioner, I am of the opinion that further detention of the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. As such, petitioner shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two 2 sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge POCSO Court, Bankura. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Bankura without the prior permission of the learned Special Court. With the aforesaid observations CRM (M) 2409 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
