Instant petition has been preferred under Section 528 of BNSS 2023, wherein the applicants are praying for quashing of Criminal Case No. 1300 of 2013, State vs. Raees and others, wherein both the applicants are facing trial for the offences punishable under Sections 147 and 324 IPC. 4. It is argued by the learned counsel for the applicant that the proceeding in question is arising out of FIR dated 25.03.2010, bearing Case Crime No. 52 of 2010 wherein charge sheet was filed and the applicants have been summoned to face the trial and were on bail. He further submits that on future dates when the applicants could not appear before the Trial Court, proceedings under Section 82/83 of Cr.P.C. have been initiated on 18.12.2025. He submits that both the applicants are now ready to face the trial and they are not pressing for quashing of the proceeding, however, since the proceedings under Section 82/83 have been initiated, therefore, the said proceeding be kept in abeyance and the applicants undertake that on the next date fixed, they will ensure their presence before the Trial Court. 5. Mr. Sain, learned A.G.A. for the State have not raised objection on such a submission of the learned counsel for the applicant. 6. In such view of the matter the instant C528 UKHC010106422026 2026:UHC:5052 application is disposed of finally with the direction to both the applicants to ensure their presence on the next date fixed before the trial court and only till then the proceeding under Section 82/83 of Cr.P.C. shall remain in abeyance. 7. It is made clear that if the applicants failed to appear before the Trial Court on the next date fixed, the proceeding initiated under Sections 82/83 of Cr.P.C. shall revive automatically.
