Page 1 of 2. IN THE HIGH COURT OF ORISSA AT CUTTACK WP(C) No. 328 of 2026 Ramesh Chandra Das ..... Petitioner Mr. D.N. Rath, Advocate -versus- State of Odisha & Ors. ..... Opposite Parties Mr. A. Tripathy, AGA CORAM: THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY ORDER 08.01.2026 Order No. 01 1. This matter is taken up through hybrid mode. 2. Heard Mr. D.N. Rath, learned counsel appearing for the Petitioner and Mr. A. Tripathy, learned Addl. Govt. Advocate appearing for the Opp. Parties. 3. The present writ petition has been filed inter alia challenging order dtd.21.11.2025 so passed by Opp. Party No. 4 under Annexure-14. Vide the said order claim of the Petitioner to get the benefit of pension and other pensionary benefits has been rejected on the ground that a proceeding is pending against the Petitioner. 4. Learned counsel appearing for the Petitioner contended that the proceeding so initiated against the Petitioner has already been quashed by this Court in its judgment dtd.08.12.2025 in W.P.(C) No. 33662 of 2025 under Annexure-13. Since proceeding in question has already been quashed by this Court in its order dtd.08.12.2025, on the ground of pendency of the proceeding, Petitioner’s claim since has been rejected vide the impugned order, the same is not sustainable in the eye of law. Page 2 of 2. 5. Mr. A. Tripathy, learned Addl. Govt. Advocate on the other hand contended that since the impugned order has been passed prior to quashing of the proceeding vide order dtd.08.12.2025, no illegality or irregularity can be found with the same. 5.1. Having heard learned counsel appearing for the Parties, considering the submission made and the fact that the proceeding initiated against the Petitioner has already been quashed by this Court in its order dtd.08.12.2025 in W.P.(C) No. 33662 of 2025 under Annexure-13, rejection of the Petitioner’s claim on the ground indicated in the impugned order is no more sustainable. 5.2. Therefore, this Court while quashing order dtd.21.11.2025 under Annexure-14, directs Opp. Party No. 4 to take a fresh decision on the claim of the Petitioner to get the pensionary benefits as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of this order. 6. The writ petition accordingly stands disposed of. (BIRAJA PRASANNA SATAPATHY) Judge Sneha
