GP FOR COMMERCIAL TAX 2 The Court made the following ORDER: (Per NJS,J) The petitioner, who is the owner-cum-driver of the Goods Carriage Vehicle bearing Reg.No.TG 04 T 6344, filed the present Writ Petition aggrieved by the action of the respondents, particularly respondent Nos.3 and 4 in continuing the detention of the petitioner’s vehicle. Learned counsel for the petitioner while making submissions, with reference to the contentions raised in the Writ Petition, sought to impress upon this Court that in similar circumstances directions were issued to release vehicle seized by the Department subject to the condition of execution of personal security bond for the value of the vehicle as determined by the concerned Road Transport Authority. In this regard, learned counsel has drawn the attention of this Court to order dated 29.04.2026 in W.P.No.11838 of 2026, while seeking similar directions. However, on the other hand, learned Assistant Government Pleader Mr.S.A.V.Sai Kumar, while pointing out that the vehicle is registered with Telangana State and in such circumstances, direction as sought may not be granted. He also placed a copy of the order dated 20.08.2025 in W.P.No.20533 of 2025, wherein basing on the factual aspects stated therein, vehicle was directed to be released with certain conditions including furnishing of Bank Guarantee. The operative portion of the Order reads as follows: “4. This Court, in similar circumstances, had issued certain directions in W.P.No.5451 of 2025, by its Order dated 05.03.2025. Following the said Order, this Writ Petition is disposed of with a direction to the 4th respondent to release the vehicle in favour of the petitioner, on 3 execution of personal security bond, for the value of the vehicle, as determined by the concerned Road Transport Authority, within a period of one (1) week. In addition, the petitioner shall also give a bank guarantee for half the value of the vehicle of the petitioner, as fixed by the concerned Road Transport Authority. There shall be no order as to costs.” In the light of the above said order, the Writ Petition is disposed of with a direction to the 4th respondent to release the subject matter vehicle, subject to the petitioner fulfilling the similar conditions extracted above.
