JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in C.C.No.28051/2023, pending before the XLVIII Additional Chief Judicial Magistrate Court, Bengaluru, for the offences under Sections 420, 465, 468 and 471 of the IPC. 2. Learned counsel for the petitioner – accused and respondent No.2 – complainant in unison submit that during the pendency of these proceedings, the parties to the lis have settled their disputes amicably by drawing up certain terms and - 3 - HC-KAR NC: 2026:KHC:13057 CRL.P No. 15221 of 2025 conditions. The parties have filed a joint affidavit before this Court seeking permission to compound the offences. 3. The joint affidavit reads as follows: “…. ….. …. 2. We state that with the intervention of well- wishers, relatives and friends we have settled the dispute amicably and we don't want to proceed with the criminal proceedings in CC.No.28051/2023 which is pending on the file of Hon'ble XLVIII Addl Chief Judicial Magistrate at Bangalore. 3. We state that since we have settled the dispute amicably out of the court, the above criminal petition kindly be allowed and entire criminal proceedings in CC.No.28051/2023 pending on the file of Hon'ble XLVIII Addl Chief Judicial Magistrate at Bangalore may be quashed. 4. We state that we have sworn to this affidavit voluntarily and not influenced by coercion, threat or undue influence. 5. We state that if this Hon'ble court is not pleased to pass an order allowing the above criminal petition and quash the entire criminal proceedings in CC.No.28501/2023 pending on the file of Hon'ble XLVIII Addl Chief Judicial Magistrate at Bangalore we will suffer irreparable loss and great hardship.” In the light of the afore-quoted joint affidavit and since the allegations are not against the State, I deem it appropriate to accept the joint affidavit filed by the parties and terminate the proceedings against the petitioner. - 4 - HC-KAR NC: 2026:KHC:13057 CRL.P No. 15221 of 2025 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed.
