p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.3198 of 2026 Mujafar Hosen @ Sk. Mujafar & Ors. …. Petitioners Mr. S.R. Panda, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Ghatagaon P.S. Case No.345 of 2025 corresponding to G.R. Case No.147 of 2025 pending in the court of learned J.M.F.C., Ghatagaon on the grounds stated. 3. Gone through the FIR as at Annexure-1. Referring to Annexure-2, a bail order of this Court in the ABLAPL, the petitioners plead for parity. But the Court finds that the petitioners had earlier approached this Court in ABLAPL No.12233 of 2025 disposed of on 1st December, 2025, a copy of which is at Flag-B. Learned counsel for the petitioners submits that in the meantime, co-accused persons are on bail and admittedly, the petitioners have antecedents as cases are regularly filed against them with similar allegations made. Considering the above facts and submissions of learned counsels for the respective parties and objection of the State p. 2 notwithstanding the order in the ABLAPL at Flag-B, this Court, in view of release of the co-accused persons in the meantime, is inclined to direct the petitioners to surrender before the court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned J.M.F.C., Ghatagaon within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with G.R. Case No.147 of 2025 on furnishing a bail bond of Rs.40,000/- (rupees forty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case subject to enquiry and absence of grievous injury received by any member of raiding party. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
