Learned advocate appearing for the petitioners submits that the petitioners were arrested on 08.06.2025 and since then they are in custody. It has been submitted that the petitioners were arrested from their home on source information being received by the police authorities. Certain documents were relied upon particularly the school certificate of one Md. Rahul Ali, (petitioner no.2) which was found to be fake. The statement of the pradhan of the local gram panchayat also reflects that no certificate was issued to the petitioner no.1, namely, Md. Manirul Ali. Learned advocate for the petitioners also submits that there are documents in their custody to show that the grand-father of the petitioners was staying in India in 1971 and his name was enrolled in the electoral role. Be that as it may, these are question of facts. Prima facie, 2 the documents which have been referred to do not support the petitioners’ case. As such, at this stage, I am not inclined to release the petitioners on bail. If the petitioners have further documents in their custody they would adduce evidence in course of the trial. Consequently, CRM(M)2202 of 2025 is dismissed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
