The instant application has been preferred under Section 528 of the BNSS 2023 by the applicant Mr. Rahul Balodi, son of Shri Mahimanand Balodi alongwith compounding application with the affidavit of respondent no.2, the wife of the applicant. Both the applicant and respondent no.2 are present in the Court and are duly identified by their respective counsel. 5. By the instant application, the applicant is praying for quashing of entire proceedings of Criminal Case No.6752 of 2025 State vs. Rahul Balodi arising out of the first information report dated 03.01.2025 bearing FIR No.0003 of 2025 registered at P.S. Vasant Vihar for the offence punishable under Sections 323, 498-A, 504 and 506 of IPC. 6. The brief facts of the case are that the applicant and respondent no.2 married each other on 22.11.2023 however due to some matrimonial discord between both of them they are living separately since 19.07.2024 and now they have decided amicably to get divorced by mutual consent. It is contended in the compounding application that on 02.01.2026 both of them have filed a petition seeking divorce by way of mutual consent and for second motion now 25.06.2026 is fixed in the concerned court. It is contended in the application that since parties have settled their dispute amicably to get divorce by way of mutual consent, therefore, the instant proceedings of Criminal Case No.6752 of 2025 be quashed. 7. It is also argued that all the offences are compoundable except the offence punishable under Section 498-A IPC and now since the parties have settled their dispute to get divorced by mutual consent, this offence can also be compounded. 8. Learned AGA submits that now the parties have resolved their dispute amicably to get divorce by way of mutual consent, therefore, continuation of the proceedings is nothing but will be a futile exercise. 9. After hearing the learned counsel for the parties and taking into consideration that parties are now agreed to get divorce by way of mutual consent and for second motion 25.06.2026 is fixed, therefore, for the end of justice, the entire proceedings of Criminal Case No.6752 of 2025 State vs. Rahul Balodi pending in the court of learned Judicial Magistrate Ist Class, Dehradun is hereby quashed. 10.
