CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 27.04.2026
02. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.95 of 2026 pending in the file of learned S.D.J.M., Nabarangpur arising out of Khatiguda P.S Case No.0010 of 2026 on the grounds stated. 3. Perused the FIR as at Annexure-1. This Court allowed interim protection to the petitioner in I.A. No.517 of 2026 till today. Mr. Pattnaik, learned counsel for the petitioner would submit that the petitioner is alleged to be a receiver of stolen articles having no other antecedent except the present one and another registered as Khatiguda P.S. Case No.3 dated 10th January, 2026. Recorded the objection of the State. It is submitted to the Court by learned ASC that the involvement of the petitioner is alleged by the witnesses examined during
investigation and he said to have received the stolen articles. As to the FIR dated 22nd January, 2026, a case under Sections 310(2) and 331(5) BNS has been registered. On an enquiry, Mr. Lenka, learned ASC for the State would submit that there has been no recovery made from the petitioner of the stolen gold ornaments etc. The Court finds that on the basis of the statements of the witnesses, the petitioner is likely to be implicated without any such recovery being made. Considering the FIR and the statements of the witnesses, copies of which are produced at the time of hearing and submissions of learned counsels for the respective parties, in absence of any material to show recovery and seizure of stolen articles received by the petitioner, this Court though not inclined to grant pre-arrest bail but is in favour of directing him to surrender before the learned court below for being released with suitable conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid.
In the event, the petitioner surrenders before the court of learned S.D.J.M., Nabarangpur within fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.95 of 2026 corresponding to Khatiguda P.S Case No.0010 of 2026 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case. It is further directed that the release of the petitioner
shall be subject to verification of other antecedents besides Khatiguda P.S. Case Nos.3 and 10 dated 10th January, 2026 and 22nd January, 2026 respectively. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Rojina Designation: Junior Stenographer
