It has also been contended that the evidence of the victim has been completed, who has implicated the present petitioner in the instant case. I have taken into account the evidence of the victim as well as the statement under Section 164 of the Cr.P.C. which is appearing in the case diary and I find that there is consistent version of the victim so far as the role of the present petitioner is concerned. The role of the present petitioner do satisfy the ingredients of Section 70(2) of the BNS. 2 Having considered the gravity of the offence and the fact the victim remained unshaken in her deposition before the court below, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, it has been brought to the notice of the Court that out of the 29 witnesses, 24 witnesses have been completed and five more witnesses are left to be examined. The learned Special Court would ensure that rest of the witnesses is complete within six months from the next date fixed. Accordingly, CRM(M) 2421 of 2025 is dismissed.
