The petitioner has been made accused in connection with Muffasil P.S. case no. 37 of 2026 instituted under Section 21 (b) (c) and Section 22(b)(c) of the NDPS Act, 1985. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner was in illegal possession of 16 grams of brown sugar, which he kept for selling and beside brown sugar, weighing machine, cash of Rs. 16,500/- was recovered from the possession of the petitioner. It is submitted that the allegation against the petitioner is false. It is next submitted that brown sugar seized was in intermediary quantity. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co- operate with the trial of the case, the petitioner has no criminal antecedent and the petitioner is custody since 16.02.2026 as stated in paragraph nos. 6 and 11 instant bail application respectively; hence, the petitioner may be admitted to regular bail. Learned Addl. P.P. opposed the prayer for regular bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge N.D.P.S., Act, Hazaribagh in connection with Muffasil P.S. case no. 37 of 2026 with the condition that the petitioner will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change the mobile phone number during the trial of the case.
