Learned advocate appearing for the petitioners submits that petitioners are in custody for more than 2 years and 3 months and out of 24 witnesses relied upon by the prosecution till date 5 witnesses have been examined. According to the petitioners there is no possibility of the trial concluding in near future, as such the petitioners may be released on bail. Learned advocate for the State submits that the State intends to examine 10 more witnesses in support of its case and some time is required to conclude the trial. Learned advocate prays for 8 months time. In view of the period of detention of the present petitioners, as a matter of last chance, 8 months time from the
2 next date is granted to the prosecution to complete the prosecution witnesses. Having regard to the prayer advanced by the prosecution, I direct the learned Trial Court to fix a schedule on each and every month for conclusion of the proposed witnesses cited by the prosecution. In case, any witness is present, the said witness should not return without being examined and the trial of the case will proceed in spite of any resolution of the local bar. No unnecessary adjournment be granted to either of the parties. At this stage, the prayer for bail of the petitioner in CRM (M) 2451 of 2025 is dismissed. State is directed to communicate this order to the learned Trial Court at the earliest, so that on and from 6th May, 2026 the next date fixed, the learned Trial Court would be in a position to reschedule the dates required to conclude the trial. The Investigating Officer of the case is present in Court. His further appearance before this Court is dispensed with. Report submitted by the State be kept with the record.
