Kausik (Allowed) CRM (NDPS) 611 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Patiram Police Station Case No. 3 of 2025 dated 01.01.2025 under Sections 21(c)/22(c)/23(c)/27A of the NDPS Act, 1985. And In the matter of : Imran Hossain Mondal ……Petitioner. Mr. Kaushik Choudhury Mr. Dwaipayan Panda ……for the Petitioner. Mr. Arindam Sen Ms. Pushpita Saha ……for the State. Learned advocate for the petitioner submits that petitioner is similarly situated as the accused who has been granted bail in CRM (NDPS) 1713 of 2025. Learned advocate for the State opposes the prayer for bail as there were call data records. There is specific observations in CRM (NDPS) 1713 of 2025 wherein the CDR having been appropriately relied upon as legally admissible evidence and on such grounds the accused was granted bail. Learned advocate for the State is unable to rebut such issue so far as the present petitioner is concerned. 2 Having regard to the aforesaid observations, further detention of the petitioner is unwarranted, as such his prayer for bail is allowed. Accordingly, Petitioner, namely, Imran Hossain Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act cum Learned Additional Sessioins Judge, 3rd Court, Dakshin Dinajpur at Balurghat. If on bail, petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 611 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
