Learned advocate for the petitioner submits that petitioner is similarly situated as the accused who has been granted bail in CRM (NDPS) 1713 of 2025.
Learned advocate for the State opposes the prayer for bail as there were call data records. There is specific observations in CRM (NDPS) 1713 of 2025 wherein the CDR having been appropriately relied upon as legally admissible evidence and on such grounds the accused was granted bail.
Learned advocate for the State is unable to rebut such issue so far as the present petitioner is concerned.

Having regard to the aforesaid observations, further detention of the petitioner is unwarranted, as such his prayer for bail is allowed. Accordingly, Petitioner, namely, Imran Hossain Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act cum Learned Additional Sessioins Judge, 3rd Court, Dakshin Dinajpur at Balurghat.
If on bail, petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 611 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
