This matter is taken up through hybrid mode. 2. Petitioners in this writ petition seek to assail the order dated 1st January, 2026 (Annexure-10) passed by the Tahasildar, Bhapur in OGLS Lease Case No.1 of 2025, whereby he rejected an application filed by the Petitioners under Section 3 of the Orissa Government Land Settlement Act, 1962 (for brevity ‘the Act’) read with Rule-5 of the Odisha Government Land Settlement Rules, 1983. 3. In course of hearing, Mr. Rath, Senior Advocate appearing for the Petitioners submits that a remedy under Section 7 of the Act is available to the Petitioners against the order impugned herein. Hence, he prays for withdrawal of the writ petition to avail the remedy of appeal under Section 7 of the Act. 4. Mr. Mishra, learned Additional Standing Counsel submits that if such an appeal is filed, the same may be considered in accordance with law. 5. Taking note of the submission made by learned counsel for the parties, the writ petition is disposed of as withdrawn with an observation that the Petitioners, if so advised, may file an appeal under Section 7 of the Act against the order under Annexure-10 within a period of three weeks hence, along with an application for condonation of delay. In that event, the Appellate Authority shall do well to consider the same in accordance with law, giving opportunity of hearing to the parties concerned.
