Lalramzauva, learned Senior Counsel assisted by Mr. Stephen Lalbuatsaiha, learned counsel for the applicants. Also heard Ms. Lalnunhlui, learned Government Advocate for the respondent nos. 1 to 3; Ms. Zairemsangpui, learned CGC for the respondent no.4 and Mr. T. Lalnunsiama, learned counsel for the respondent no. 5. 2. This interlocutory application has been filed by some of the writ petitioners in WPC No.74/2019 with a prayer that this Court would allow the deletion of the names of the applicants from the list of petitioners in WP(C) 74 of 2019 and allow necessary modification in the cause title of the original writ petition. 3. The writ petition was disposed of on 23.09.2025 with the following directions: “In view of what has been discussed above, the writ petition is disposed with a direction to the District Collector (respondent No.3) to make an assessment of the solatium and interest to which each of the petitioners would be entitled to for acquisition of their land which was covered by the Award No. 5/2007 and to thereafter pass a concise and consolidated award on the entitlements of the petitioners. The respondents will be at liberty to verify the identity of the petitioner's vis-à-vis the beneficiaries of the Award No.5/2007. The entire exercise should be done as expeditiously as possible, in any case, within the outer limit of 3(three) months from the date of the receipt of the certified copy of this order. On determination and pronouncement of the entitlement of the petitioners by the District Collector as directed hereinabove, the respondents No. 4 & 5 shall process and deposit the awarded amount within a period of 3(three) months from the date of receipt of the Award from the Collector. On receipt of the award, the concerned authority shall take timely steps for disbursal of the amount within a period of 1(one) month.” 4. The learned Senior counsel appearing for the applicants has submitted that on a bona fide mistake on the part of the counsel who had drafted the writ petition, the names of the present applicants, who were arraigned at Serial No. 89 to 465, Serial No.623 to 783 and Serial No.784 to 961 and who were not involved in the litigation of award No.5 of 2007 had been included as petitioner in the writ petition. It was on the bona fide mistake of the counsels that the Page No.# 48/51 names had been included in the present writ petition, although they were owners of the land involved in another award, namely draft Award No.2 of 2008. 5. The learned Senior Counsel has submitted that the names of the applicants are required to be deleted or shown as deleted from the list of petitioners in WP(C) 74 of 2019 (D) , so that their rights to pursue remedies in connection with Draft Award No.2 of 2008 do not suffer in any manner. 6. Resisting the interlocutory application, Ms. Lalnunhlui appearing for the respondent No.1, 2 and 3 has submitted that the present I.A. is misconceived, inasmuch as, after passing of the orders in the writ petition, the Court had become functus officio and it does not retain jurisdiction to entertain an application after litigation was closed on disposal. 7. She has submitted that this is not an application for correction of clerical or arithmetical error and neither is it an application for extension of time. A post- disposal application for modification or clarification of orders of disposal shall lie only in rare cases, where the order passed by this Court is executory in nature and the directions of the Court may become impossible to be implemented because of subsequent event or development. She has submitted that this application does not fit into any of the above descriptions and therefore, this application deserves to be dismissed. She has placed reliance on the judgment of the Apex Court in Ajay Kumar Jain vs. State of Uttar Pradesh and Another reported in (2024) SCC Online SC 3677, Lamba Exports Pvt. Ltd. vs Dhir Global Industries Pvt. Ltd. and Others reported in (2026) SCC Online SC 459, Jaipur Vidyut Vitran Nigam Limited and Others vs. Adani Power Rajasthan Limited and Another reported in (2024) 19 SCC 353. Page No.# 49/51 8. Learned Counsel appearing for the respondent No.5 has supported the case of the respondent No. 1 to 3 and has submitted that the present application does not deserve the attention of this Court. 9. Responding to the submissions made by the learned counsel appearing for the respondents, Mr. C. Lalramzauva, learned Senior counsel has submitted that the aforesaid judgment had been considered by the Apex Court along with other cases in the case of Gagan Banga and Another vs. State of West Bengal and Others, reported in (2024) INSC 722 and after consideration of the circumstances, this Court at para-12 had noted as follows: “However, when the individual facts of a particular case so warrant, there can be no bar to entertaining a clarification/modification petition in a disposed of case. This would necessarily depend on the facts and circumstances of that individual case. Notably, Rule 6 of Order LV of the Supreme Court Rules, 2013, states that nothing in the said Rules shall be deemed to limit or otherwise affect the inherent powers of the Court to make such orders as may be necessary for the ends of justice or to prevent abuse of the process of the Court. Therefore, if any such abuse of process is noticed after the disposal of the case or if a modification is found essential to meet the ends of justice, this Court would be justified in entertaining an application in a disposed of case and exercising such power.” 10. I have heard the learned counsel for the parties and I have considered the judgments list before me. 11. There is no doubt in the mind of the Court that Interlocutory Applications or Miscellaneous Applications are preferred only when the applicants, in reality, seek a review and re-hearing which would not be permissible. It is only in rare cases that post disposal applications may be entertained. This Court agrees that there has to be finality to judgments and great sanctity is to be attached to such finality. This Court is averse to allow parties to reopen concluded judgments by filing Interlocutory Application since the same would amount to abuse of the process of law which may have adverse impacts on the administration of justice. Page No.# 50/51 12. In the present case, the applicants have not argued upon the merits or directions on the claim made by the writ petitioners in WP(C) 74/2019. The applicants have not prayed for any change/modification or correction in the order dated 23.09.2025 in WP(C) No.74/2019. The limited prayer of the applicants is that, since they were not involved in the litigation of award No.5 of 2007, the order dated 23.09.2025 ought not to curtail their rights to pursue remedies in connection with draft award No.2 of 2008, wherein their land was involved. 13. The reason for approaching this Court, has been explained by the applicants to the effect that, when the respondent authorities received the judgment and order dated 23.09.2025 passed in WP(C) 74 of 2019, a process for seeking clarification has been initiated as to whether the assessment for payment of interest and solatium as directed by the Court in the order under consideration should be restricted for beneficiaries of award No.5 of 2007 only. 14. Apprehending that the implementation of the order dated 23.09.2025 may be delayed due to the inclusion of the name of the applicants in the array of parties in the WP(C) 74 of 2019, this Interlocutory Application has been filed. Agreeing with the law laid down by the Apex Court regarding the maintainability of interlocutory applications or miscellaneous applications in disposed of matter, I am of the considered opinion that this interlocutory application is not maintainable in law and therefore is not entertained and dismissed. Moreover, modification of Cause Title of a writ petition cannot be allowed after a writ petition stands disposed of. 15. However, in the interest of justice and to facilitate implementation of orders passed in the writ petition, it is clarified that since this Court in order dated 23.09.2025 had required the respondents to make an assessment of the Page No.# 51/51 solatium and interest to which the petitioners would be entitled for acquisition of the land which were covered by Award No.5 of 2007, the respondents are required to take into account the Award No. 5 of 2007 and implement the judgment dated 23.09.2025 with regard to those petitioners in the writ petition, who were litigants in the ward No.5 of 2007.
