For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 21/05/2026 1. Apprehending his arrest in connection with FIR No.217/2025, registered with Police Station Sikari, District Deeg for the offences under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(2), 317(4), 317(5), 303(2), 313 and 61(2) of BNS and Section 66-D of IT Act, the accused-petitioner has preferred this criminal miscellaneous bail application under Section 482 of B.N.S.S. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the accused-petitioner is ready and willing to cooperate with the investigation. It is further contended that the name of the accused-petitioner is not mentioned in the FIR and the custodial interrogation of the accused-petitioner is not required, the accused-petitioner is ready and willing to submit his mobile phone before the Investigating Agency, therefore, his anticipatory bail application may be allowed. [2026:RJ-JP:21652] (2 of 3) [CRLMB-5451/2026] 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application. 4. Heard and perused material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and the fact that the main accused has already been enlarged on bail, the accused-petitioner is ready and willing to co- operate with the investigation and custodial interrogation of the petitioner is not required, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to allow the anticipatory bail application of the accused-petitioner. 6. Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioner- Sonu S/o Birjiram, in connection with FIR No.217/2025, registered with Police Station Sikari, District Deeg, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court. (iv) that the petitioner would submit his Mobile phone and Sim Cards before the concerned Investigating Officer.
