THIS CRL.P IS FILED U/S 482 CR.PC PRAYING TO QUASH THE ENTIRE PROCEEDINGS AGAINST THE PETITIONER NO. 01 IN C.C NO 1656/2023 ON THE FILE OF THE HON’BLE JMFC III, COURT FOR THE ALLEGED OFFENCES PUNISHABLE UNDER SECTION 504, 354, 323 AND 379 OF IPC, ARISING OUT OF CRIME NO. 94/2022 PERTAINING TO THE URWA POLICE STATION.

ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused and the de facto complainant are before this Court calling in question proceedings in C.C.No.1656/2023, pending before the Court of JMFC III, Mangaluru, for the offences punishable under Sections 504, 354, 323 and 379 of the IPC.
2. Learned counsel for the petitioners and respondent No.2 in unison submit that during the pendency of the proceedings before the trial Court in C.C.N.1656/2023, the parties to the lis have settled their dispute amicably among themselves with the intervention of the well-wishers. Therefore, they are before this Court seeking permission to

HC-KAR NC: 2026:KHC:13422 CRL.P No. 3384 of 2026 compound the offences by filing a joint application in I.A.No.1/2026 and a joint affidavit is filed before this Court.
3. The joint application reads as follows:
“04. It is submitted that Petitioner No.02 / De-facto Complainant has no objection for quashing the criminal proceedings pending against the Petitioner No.01 in the above case.
05. It is submitted that, The parties further submit that the dispute between them has been voluntarily resolved without any coercion, pressure, or undue influence.
06. It is submitted that, Therefore, the Petitioners jointly request that this Hon'ble Court be pleased to record the fact of amicable resolution between the Petitioners and pass appropriate orders under Section 482 of the Code of Criminal Procedure, 1973 in the interest of justice and equity. WHEREFORE, the petitioners in the above Criminal Petition jointly request to allow the above application and consequently quash the proceedings in C.C. NO. 1656/2023 pending on the file of Hon'ble JMFC (III Court), Mangaluru arising out of Crime No. 93/2022 of the Urva Police Station for offences punishable under Sections 504, 354, 323 and 379 of IPC in the interest of justice.”

HC-KAR NC: 2026:KHC:13422 CRL.P No. 3384 of 2026 Though the offences alleged against the petitioner in the case at hand inter alia is the one punishable under Section 504 of the IPC, which is non-cognizable offences, since it is a dispute between the parties and the allegations are not against the State, I deem it appropriate to accept the joint application – I.A.No.1/2026 and the joint affidavit and terminate the proceedings against the petitioner.
4. For the aforesaid reasons, I pass the following:
ORDER (i) The criminal petition is disposed. (ii) I.A.No.1/2026 stands allowed. (iii) The proceedings in C.C.No.1656/2023, pending before the Court of JMFC III, Mangaluru, stand quashed. SD/- (M.NAGAPRASANNA) JUDGE NVJ List No.: 2 Sl No.: 72 CT:SS
