1. This instant application under Section 482 of BNSS is filed by the petitioner-applicant Chatruram Son Of Nanuram for seeking anticipatory bail in event of arrest in connection with FIR No.184/2025 dated 17.07.2025 registered at P.S. CPS Jaipur District - ACB for alleged offence under Sections 13(1) (e), 13(2), 13(1)(b) of PC Act.
2. Learned counsel for the applicant submits that the applicant has falsely implicated in a concocted criminal case. He also submitted that the applicant is facing threat of arrest due to ulterior motive and to fulfill personal vendetta of complainant though there is no evidence against the petitioner-applicant. He further submitted that the petitioner is a law abiding

Learned counsel for petitioner submitted that applicant has been superannuated from the job and now his age is more than 64 years and he is physically handicapped. He further submitted that the wife of petitioner is also physically handicapped. He further submitted that the ACB has computed market value of the property which was acquired in 1981 from in-laws of petitioner. He further referred the computation process and submitted that the computation by the ACB is contrary to the settled norms under the law. He further submitted that this is a case of harassment wherein no heed was paid to the representation submitted by the petitioner. 4. Learned Public Prosecutor has opposed the bail application and submitted that the allegations against the petitioner are grave and serious, therefore, at the stage of investigation, the petitioner-applicant, is required for investigation, hence, he is not entitled to anticipatory bail. 5. Heard learned counsel for the petitioner-applicant and learned Public Prosecutor. Perused the material available on record submitted by both the parties. Also considered the submission sof Mr. Sunil Sihag, Additional SP, ACB, Jaipur. 6. The material on record indicated that on 07.09.2021 a complaint was received against the petitioner which was verified and on 15.09.2021 the petitioner was trapped while taking bribe of ₹20,000 from the complainant. The ACB has registered a case against the petitioner. The ACB has

Now the inquiry has been concluded and on 17.07.2025 FIR No. 184 was registered at PS CPS, Jaipur under Sections 13(1)(e), 13(2), 13(1)(b) and 13(2) of Prevention of Corruption Act, 1988 and Amended Act of
2018. 7. Admittedly, the petitioner has attained the age of superannuation. The ACB has drawn conclusion on the basis of the statements received by them from the office about the income. The valuation of assets and expenditure has been calculated by the ACB, whatever be the method adopted by the ACB, the issue is that the petitioner has already attained the age of superannuation and his age is 64 years. The petitioner has claimed that he is a physically challenged person as well. Except the present case of ACB, there is one other case relating to PC Act is pending against the petitioner.
Since the computation is based upon material available with the ACB, and there is no need for any custodial interrogation, therefore, it is a fit case to enlarge petitioner on anticipatory bail. 8. Having considered the police report and the material placed on record for perusal, the matter is still at the investigation stage, but the investigation so far indicates that the petitioner-applicant is not required for custodial interrogation. Considering the assurance of cooperation, without expressing any opinion on role of the present petitioner-applicant, it is appropriate to grant anticipatory bail. In view of the facts and circumstances of the case, the bail application under Section 482 BNSS, is hereby allowed and it is ordered that in the event of arrest of petitioner-applicant Chatruram Son Of Nanuram in connection with FIR No.184/2025 dated 17.07.2025 registered at P.S. CPS Jaipur District ACB for offence under Sections 13(1)(e), 13(2), 13(1)(b) of PC Act, the applicant Chatruram Son Of Nanuram shall be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Investigating Officer on the following conditions:- (i) Till completion of investigation, the applicant shall not leave the jurisdiction of the State of Rajasthan without prior permission of the concerned Court. (ii) The applicant shall make himself available for interrogation by the Investigating Officer as and when required in relation to present criminal case. (iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Investigating Officer during investigation. (iv) The applicant shall not tamper with any evidence or try to influence any witness in any manner. (v) The applicant shall disclose his passport number, if any, to Investigating Officer and shall not leave the Country without prior permission from the concerned Court.
