Bhuyan, learned Senior Counsel assisted by Mr. N. R. Sarmah, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Pranab Mandal has prayed for granting him transit anticipatory bail in respect of Hubballi Dharwad Cyber Crime P.S. Case Page No.# 2/2 No.05/2026, under Section 66(D) of the IT Act, 2008 and 318(4) of the BNS, 2023. 3. The petitioner has received a notice under Section 35(3) of the BNSS, 2023. It is submitted on behalf of the petitioner that he is presently suffering from jaundice and, therefore, seeks at least 30 (thirty) days' time to enable him to recover and appear before the police authorities at Hubballi. 4. I have heard the submissions made by the learned counsel of both sides. 5. Since, the petitioner is suffering from jaundice and he is interested in facing the trial at Karnataka, his application is allowed. 6. It is hereby directed that, in the event of his arrest within the next 30 (thirty) days from today in connection with Hubballi Dharwad Cyber Crime P.S. Case No.05/2026, the petitioner, Pranab Mandal shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the arresting authority. 7. With the aforesaid direction, this anticipatory bail application stands disposed of. JUDGE Comparing Assistant
