Heard Mr.Amit Kumar, learned counsel for the petitioner as well as Mr.P.K.Bhaduri, learned Deputy Advocate General appearing for respondents No.1 to 3/State. 2. The petitioner has filed this petition with following prayers:- “10.1 That, this Hon'ble Court Kindly be pleased to Issue a appropriate writ, order, or direction, commanding the Respondents No. 1 to 3 (Chhattisgarh State/Police) to produce the detenu, Ananya Sahu, before this Hon'ble Court. 10.2 That, this Hon'ble Court may kindly be pleased to Issue a Direction to Respondents No. 4 to 6 (State of Haryana & Police) to provide all necessary logistical support, security, and cooperation to the Chhattisgarh Police authorities to facilitate the safe recovery of the detenu from the illegal custody of Respondent No. 7. 10.3 That, this Hon'ble Court Kindly be pleased to direct the Respondent authorities to set the detenu at liberty from the illegal confinement of Respondent No. 7 and 3 restore her to the safe custody and guardianship of the Petitioner (her father). 10.4 That, this Hon'ble Court Kindly be pleased to direct the Police Authorities to provide adequate protection to the Petitioner and the detenu from any threats or harassment by the Respondent no. 7 during and after the recovery process.” 3. Learned counsel for the petitioner submitted that the petitioner is the father of the victim daughter, who is at present living with respondent No. 7-Subhash Kumar, at Mandnaka, Police Station Hathin, District Palwal (Haryana). He further submits that the petitioner has lodged a missing report regarding his daughter at the concerned police station. The petitioner has filed the present petition seeking the release of his daughter (detenu) from the custody of respondent No. 7, with whom she is living in District Palwal (Haryana). Earlier, the petitioner had approached this Court by filing WPHC No. 10/2026, which was dismissed as not maintainable since a missing report had already been lodged. Hence, the present writ petition has been filed for the aforesaid reliefs. 4. Learned Deputy Advocate General appearing for respondents No. 1 to 3/State has submitted, based on the instructions received, that the missing report lodged by the petitioner regarding the whereabouts of the detenu was duly inquired into. It is further 4 stated that, on the basis of missing report, a dastyabi panchnama was prepared on 23.12.2025 at Cyber Cell, Palwal, District Palwal (Haryana). Additionally, the statement of the victim’s uncle, namely Naresh Kumar Sahu (brother of the petitioner), was recorded, in whose presence the police visited Palwal. The victim’s statement was also recorded through WhatsApp video calling, in which she stated that she is living with respondent No. 7, Subhash Kumar, of her own free will. 5. In view of the above, we are not inclined to interfere in the matter. Accordingly, the writ petition is dismissed, leaving it open to the petitioner to take recourse to appropriate legal remedies for redressal of his grievance further, if any, before the court of competent jurisdiction.
