Instant application has been preferred by the applicants under Section 528 of BNSS 2023 alongwith the compounding application for quashing of the entire proceedings of Criminal Case No.350 of 2024 State vs. Parvesh Malhotra and others arising out of First Information Report dated 12.08.2023 bearing FIR No.0106 of 2023 registered at P.S. Kelakhera, District Udham Singh Nagar for the offences punishable under Section 3/4 of Dowry Prohibition Act and Section 323, 498-A, 504, 506 of IPC. 5. The applicant no.1 and respondent-wife are present in the Court and they are duly identified by their respective counsel. 6. The compounding application is supported with the affidavit of applicant no.1 and respondent-complainant Manisha Mehta, wife of applicant no.1 with this contention that now both of them have resolved their all disputes amicably and now decided to live together. 7. The respondent-wife is present in the Court and submits that she do not want to pursue the case since she has now resolved all the disputes with her husband, in-laws and other family members, therefore, the proceedings arising out of first information report dated 12.08.2023 be quashed. 8. Mrs. Menakshi Sharma, learned AGA submits that since the dispute appears to be matrimonial one and now they have resolved all the disputes, therefore, continuation of Criminal Case No.350 of 2024 is completely a futile exercise and in such view of the matter since now the parties have resolved their matrimonial dispute and now decided to live together, no useful purpose will be served to continue the proceedings. 9. In such view of the matter, present misc. application as well as compounding application are allowed. The entire proceedings of Criminal Case No.350 of 2024 State vs. Parvesh Malhotra and others pending in the court of learned Additional Civil Judge/Judicial Magistrate, Bazpur, District Udham Singh Nagar is hereby quashed.
