IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2652 of 2026 Pinku Ranjan Swain …. Petitioner(s) Mr. Sapan Kumar Lenka, Advocate -versus- State of Odisha …. Opposite Party(s) Ms. Suvalaxmi Devi, ASC CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 22.04.2026 01. 1. Heard. 2. The petitioner is seeking pre-arrest bail in connection with Kujang P.S. Case No.535 of 2024 corresponding to G.R. Case No.1158 of 2024 registered for the alleged commission of offences punishable under Sections 126(2)/296/115(2)/118/109/351(3) of the BNS, 2023, pending in the Court of the learned J.M.F.C., Kujang. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. Earlier, the petitioner had approached this Court by moving ABLAPL No.12672 of 2024, which was disposed by the Coordinate Bench of this Court vide order dated 18.11.2024, directing the petitioner to surrender before the trial Court within four weeks and move bail application. It was also directed that the Court shall release the petitioner on bail in connection with the F.I.R. in subject. 5. Learned counsel for the petitioner submits that he could not avail the benefit of the order dated 18.11.2024 by surrendering before the trial Court within the time frame granted by the Coordinate Bench. Therefore, he has approached this Court by filing the present bail application afresh. 6. Since the petitioner is seeking to avail the benefit of the order dated 18.11.2024 passed by the Coordinate Bench of this Court and basically seeking extension of time to surrender before the trial Court, it would be appropriate for the petitioner to move application before the Coordinate Bench seeking extension of time for surrendering before the trial Court. Therefore, the present bail application is not maintainable. 7. Hence, the ABLAPL is disposed of granting liberty to the petitioner to move appropriate application before seeking extension of time. If such application is filed registry shall process it and list it for hearing. (S.S. Mishra) Judge Subhasis Designation: Personal Assistant Location: High Court of Orissa, Cuttack.
