(The Accused Petitioner Presently Confined In District Jail Bharatpur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Rajneesh Gupta with Ms. Chanchal For Respondent(s) For Complainant : : Mr. Jaiprakash Tiwari, PP Mr. Timan Singh HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 06/05/2026
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.612/2025 registered at Police Station Sewar, District Bharatpur for offences under Sections 85, 80(2) and 103(1) of BNS, 2023.
2. Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record.
3.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the marriage of the petitioner with the deceased, Priyanka, was solemnized on 24.11.2018, and till date of incident 15.11.2025 no complaint was ever lodged by the prosecutrix side regarding any demand of dowry. He submits that it is apparent from the perusal
[2026:RJ-JP:19106] (2 of 2) [CRLMB-3995/2026] of the charge-sheet that the telephonic call, as alleged by the complainant in his FIR, is not substantiated. As per the charge- sheet, it appears that the deceased was insisting on going to Jaipur, and when the petitioner refused to do so, the deceased committed suicide, which is apparent from the statement of the witness, Reecha Sharma, who was present at the time of the incident. The petitioner is behind bars since 15.12.2025, and the charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed.
4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submission made on behalf of petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Jogendra Singh Sinsinwar @ Akash S/o Shri Govind Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
