SATAPATHY Order No. ORDER(ORAL):22.04.2026 03. 1. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 2. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Banapur PS Case No.394 of 2024 corresponding to GR Case No.596 of 2024 pending in the file of learned JMFC, Banapur, for commission of offences punishable U/Ss.309(4)/3(5) of BNS r/w Sections 25/27 of Arms Act, on the main allegation of committing robbery by taking away cash of Rs.8,30,000/-, one cheque and a mobile phone from the staffs of the rice mill of the informant. 3. Heard, Mr. Manas Kumar Chand, learned counsel for the petitioner in BLAPL No.1222 of 2026; Mr. Amitav Tripathy, learned counsel for the petitioner in BLAPL No.12802 of 2025 and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record. 4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioners for committing dacoity, but the petitioners have been arrested on 23.11.2024, however, they have been correctly identified in the TI parade. Besides, the petitioner-Tina @ Trilochan Behera is having 25 criminal antecedents to his credit, whereas the petitioner-Hare Krishna Pradhan @ Haria @ Harekrushna Pradhan is having 2 criminal antecedents to his credit including one for similar offence. In the aforesaid facts and circumstance and taking into account the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the criminal antecedents reported against each of the petitioners, this Court is not inclined to grant bail to any of the petitioners. 5. Hence, these two bail applications of the petitioners namely Tina @ Trilochan Behera (In BLAPL No.1222 of 2026) and Hare Krishna Pradhan @ Haria @ Harekrushna Pradhan (In BLAPL No.12802 of 2025) stand rejected. Accordingly, these BLAPLs stand disposed of. 6. It is, however, open to the petitioners to renew their prayer for bail, if the trial does not commence within three months hence. A copy of this order be immediately transmitted to the learned trial Court for reference. (G. Satapathy) Judge Subhasmita
