Heard the parties.
The petitioners have been made accused in connection with Lapung P.S. Case No.16 of 2025 registered for the offences punishable under Section 191(2), 191(3), 190, 126(2), 127(2), 115(2), 118(1), 117(2), 118(2), 121(1), 121(2), 109(1), 132, 61(2), 324(4), 352 of the BNS, 2023 and under Section 27 of Arms Act.
Learned counsel for the petitioners submit that the allegation against the petitioners is that the petitioners were member of an unlawful assembly and in prosecution of the common object of the assembly assaulted the police personnel who arrived at the place of occurrence where an adjudication as per local custom by way of Panchayat was going on between two rival parties in respect of land dispute. It is submitted that the allegation against the petitioners is false. It is next submitted that the petitioner no.1 is named in the FIR and petitioner no.2 is not named in the FIR. It is then submitted that some of the co-accused persons have been granted anticipatory bail and some others have been granted regular bail. It is also submitted that charge sheet has already been submitted in this case. It is further submitted that the petitioners undertake that they will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly
submitted that the petitioners have been in custody since 08.11.2025 as is evident from para-22 of the instant bail application. Hence it is submitted that the petitioners be released on bail.
Learned Spl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioners are
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-XII, Ranchi in connection with Lapung P.S. Case No.16 of 2025 with the condition that they will co-operate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change their mobile numbers during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
