Heard the parties.
The petitioner has been made accused in connection with Galudih P.S. Case No.01 of 2026 registered for the offences punishable under Sections 103, 61(2) and 3(5) of the B.N.S. Act, 2023 and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of Tarapado Mahto. It is next submitted that the petitioner has been implicated in this case only on the basis of suspicion and as on an earlier occasions he assaulted the deceased and in respect of which Galudih P.S. Case no. 31 of 2025 was registered, but the said case ended up in a compromise and on the basis of such compromise Haradhan Singh was released on bail vide order dated 17.12.2025. It is next submitted that the only allegation against the petitioner is that the petitioner conducted recce of Tarapado Mahato, but the allegation of killing him is against Vikas Dubey @ Rahul Dubey, Abhishek Kumar @ Golu and Jagganth Baro. It is then submitted that the petitioner undertakes that he will co- operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has been in custody since 21.01.2026 as mentioned in para-17 of the instant bail application. Hence it is submitted that the petitioner be
released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. at Ghatshila in connection with Galudih P.S. Case No.01 of 2026 with the condition that he will co- operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
