The petitioners claim to be the recorded owner of R.S. Dag No.105 within Mouza-Krishnanagar in the District of Howrah. The petitioners states that there is a PWD road running adjacent to the aforesaid property of the petitioners. The petitioners alleges that the private respondents have raised an unauthorised construction by encroaching upon a portion of the PWD road just in front of the property of the petitioner thereby causing obstruction to the ingress and egress of the petitioners from their property to the PWD road. The petitioner submitted a representation dated September 9, 2025 before various authorities. The learned advocate appearing for the petitioners submits that in spite of receipt of such representation, no steps have been taken by the respondent authorities till date to remove the unauthorised encroachment. 2 Mr. De, learned Additional Government Pleader submits that no representation has been submitted before the Assistant Engineer, Public Works Department (Roads), Howrah, being the respondent No.4. Faced with such situation, the learned advocate for the petitioner prays for liberty to submit a comprehensive representation before the appropriate authority ventilating their grievances with regard to the encroachment upon the PWD road. In the light of the submissions made by the learned advocate for the petitioner, WPA 23579 of 2025 stands disposed of by giving liberty to the petitioners to submit a comprehensive representation to the Assistant Engineer, Public Works Department (Roads), Howrah, being the respondent No.4 and if such a representation is submitted, such authority shall consider and dispose of the same as expeditiously as possible in accordance with law. It will be open to the said respondent to cause necessary inspection and demarcation if the same is felt necessary. There will be no order as to costs.
