Page No.# 2/2 This application under Section 151 of the Code of Civil Procedure is preferred by the applicants for returning the record of MAC Case No.98/2023 to the learned Member, Motor Accident Claims Tribunal, Bongaigaon, for disbursement of the awarded amount. Mr. Khan, learned counsel for the applicants submits that the applicants have preferred one MAC Appeal, being MAC App. No.25/2026 and the same is pending before this Court for hearing and the TCR has also been received and in the meantime, the respondent/opposite party has deposited the awarded amount before the learned Member, Motor Accident Claims Tribunal, Bongaigaon. But, the said amount could not be disbursed the learned Member on account of non-availability of the record of MAC Case No.98/2023. In view of the submission of Mr. Khan, learned counsel for the applicants and also considering the facts and circumstances on the record, it is provided that the learned Member, Motor Accident Claims Tribunal, Bongaigaon shall open one supplementary file and thereafter, release the awarded amount in favour of the applicants.
