This writ petition is filed seeking a direction to the Court of I Additional Principal Judge, Family Court, Bengaluru (hereinafter referred to as the ‘Family Court’) to dispose of Crl.Misc.No.904/2022, which is pending on its file in a time-bound manner. 3. Learned counsel for the petitioner submits that petitioner No.1 is the wife of the respondent. The - 3 - HC-KAR NC: 2026:KHC:15939 WP No. 4744 of 2026 petitioner filed Crl.Misc.No.904/2022 to issue an order of fine levy warrant as contemplated under Section 125(3) of the Cr.PC. He submits that, the petitioner is suffering grave financial hardship on account of continued non- payment of interim maintenance and maintenance amount has to be paid to school going child (petitioner No.2). Hence, he prays for a time-bound disposal of the pending criminal miscellaneous case. 4. Records would disclose justification in the submission made by learned counsel for the petitioner. Therefore, this Court directs the Court of I Additional Principal Judge, Family Court, Bengaluru to dispose of criminal miscellaneous case. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of I Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of Crl.Misc.No.904/2022 as - 4 - HC-KAR NC: 2026:KHC:15939 WP No. 4744 of 2026 expeditiously as possible on receipt of copy of this order. (iii) There is no need to issue notice to the respondent as no adverse orders are passed and taken up for final disposal in the interest of both the parties. (iv) As the writ petition is disposed of without notice to respondent, Family Court is directed to serve copy of this order to respondent about filing of this petition and its disposal. (v) Both the parties are directed to co-operate for speedy disposal of pending Crl.Misc.No. 904/2022. (vi) Registry is directed to forward copy of this order to the concerned Court, forthwith.
