JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.17961/2022, pending before the V Addl. CJM, Bengaluru, for the offences under Section 498-A of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Nataraj D, learned counsel appearing for the petitioners, Sri.Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Smt.Chitra T, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application under Section 320 read with section 482 of the Cr.P.C., along with the affidavit. The compounding application reads as follows: “The Petitioner and the Respondent No.2 jointly submit before this Hon'ble Court as follows: 1. The Respondent No.2 herein has lodged a complaint before the Respondent No.1 Police registered the FIR and same is pending in CC No.17961/2022 (Crime No.194/2010 of Cottonpete PS) pending on the file of the - 4 - HC-KAR NC: 2026:KHC:12121 CRL.P No. 2883 of 2026 5th Additional Chief Judicial Magistrate, Bengaluru City for offences punishable under Section 498(a) of IPC and also along with the section 3 and 4 DP Act. 2. The Petitioners and Respondent no.2 are family members and petitioners and complainant is also good family members they are settling the matter without any condition against each others. 3. The Petitioners and Respondent No.2 submit that at the intervention of well-wishers the Petitioners and Respondent No.2 are intending to compound the case and the Respondent No.2 is not intending to proceed further with the case against the petitioners. 4. The Respondent No.2 further submits that there is no coercion or compulsion on her to compound the offence, but on her own freewill agreed to compound the case. Hence this application seeking kind permission of this Hon'ble Court to compound the offences. 5. There has been a lot of changes in the circumstances from the date on which the complaint was filed to this day and the circumstances now warrant that the petitioners and the victim lead a happy individual life. 6. The statements made in the accompanying application are true and correct to the best of our knowledge, information and belief and nothing has been concealed nor misrepresented and this is our name and signatures PRAYER WHEREFORE, this Hon'ble Court may kindly be pleased to accord permission to compound the offence in CC No.17961/2022 (Crime No.194/2010 of Cottonpete PS) pending on the file of the 5th Additional Chief Judicial Magistrate, Bengaluru City for offences punishable under Section 498(a) of IPC and also along with the section 3 and 4 DP Act, as prayed for therein in the interest of justice and equity.” - 5 - HC-KAR NC: 2026:KHC:12121 CRL.P No. 2883 of 2026 4. In the light of application for compounding being filed along with the affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.17961/2022, pending before the V ADDL. CJM, Bengaluru, stands quashed qua the petitioners.
