JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused Nos.1 to 3 are before this Court calling in question proceedings in C.C.No.73316/2025, pending before the 11th Additional Chief Judicial Magistrate Court, Mayohall, Bengaluru, for the offences punishable under Section 85 of the BNS and Section 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions during the pendency of these proceedings. - 3 - HC-KAR NC: 2026:KHC:17887 CRL.P No. 4413 of 2026 Therefore, they are before this Court seeking permission to compound the offences. They have filed an application under Section 359 r/w. 528 of the BNSS along with joint affidavit of the parties to that effect. 3. The application reads as follows: “3. That, after filing of the case the accused no.1 and respondent no.2 had settled their issue amicably and respondent no.2 agreed to withdraw and the criminal case in CC No.73316/2025 on the file of the 11th Additional Chief Judicial Magistrate Mayohall, At Bangalore City and the Respondent no.2 withdrawn the above said criminal case and also agreed to cooperate for quashing the above criminal petition. 4. The petitioners and Respondent No.2 submit that at the intervention of well-wishers the Petitioners, Respondent No.2 and Accused No.1 are intending to compound the case and the Respondent No.2 is not intending to proceed further with the case against the petitioners. 5. The Respondent No.2 further submits that there is no coercion or compulsion on her to compound the offence, but on her own freewill agreed to compound the case. Hence this application seeking kind permission of this Hon'ble Court to compound the offences. WHEREFORE this Hon'ble Court may kindly be pleased to accord permission to compound the offence in C.C No. 73316/2025 on the file of the 11th Additional Chief Judicial Magistrate Mayohall, At Bangalore City of Banaswadi Police Station, Bengaluru for the offences punishable under sections. 3, 4 of Dowry Prohibition Act, 1961 and U/s 85 of BNS-2023, as prayed for therein in the interest of justice and equity.” - 4 - HC-KAR NC: 2026:KHC:17887 CRL.P No. 4413 of 2026 In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms as afore-quoted and terminate the proceedings against the petitioners, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed.
