Mr. Gaurav Singh, learned counsel for the applicant. Mr. Pankaj Kumar Joshi, learned A.G.A. for the State of Uttarakhand. 2. Applicant-Arman seeks anticipatory bail in connection with F.I.R. No. 350 of 2024, registered under Sections 147, 148, 149 and 307 of the Indian Penal Code, 1860, at Police Station Kotwali Roorkee, District Haridwar. 3. Heard learned counsel for the parties and perused the record. 4. According to the prosecution, the F.I.R. was lodged by Constable Soban Singh of Police Station Civil Lines, Roorkee on 29.05.2024. It is alleged therein that while he, along with other police personnel, was performing traffic duty, one Danish informed them that some persons carrying weapons were present behind a petrol pump. Thereafter, about 10–12 persons riding motorcycles arrived at the spot and opened fire, in which one Rajat Kushwah sustained injuries. Thereafter, all the assailants fled from the spot, whereupon the present F.I.R. was lodged against unknown persons. 5. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has been roped in solely on the UKHC010106672026 2026:UHC:5069 basis of the statement of a co-accused. He further submits that the applicant was neither present at the place of occurrence nor named in the F.I.R., which was initially lodged against unknown persons. It is also submitted that no incriminating material has been recovered from the possession of, or at the instance of, the applicant. He further contends that co-accused Sahalam @ Bhura has already been granted interim anticipatory bail by this Court vide order dated 09.07.2024 and, therefore, on the ground of parity, the present applicant is also entitled to anticipatory bail. 6. Learned State Counsel vehemently opposed the anticipatory bail application and, on instructions, submitted that the investigation against the present applicant and two other accused persons is still in progress, whereas the charge- sheet has already been filed against eight other accused persons. 7. Having considered the submissions advanced by learned counsel for the parties and upon perusal of the material available on record, this Court is of the opinion that the applicant has made out a fit case for grant of anticipatory bail. Accordingly, the present anticipatory bail application deserves to be allowed. 8. Accordingly, the anticipatory bail application is allowed. 9. In the event of arrest, the applicant shall be released on anticipatory bail on furnishing a personal bond in the sum of Rs. 50,000/- with two reliable sureties of the like amount each, to the satisfaction of the Investigating Officer, subject to the following conditions: (i) The applicant shall co-operate with the investigation. (ii) The applicant shall not approach any witness/victim in any manner, whatsoever. (iv) The applicant shall deposit his passport with the Investigating Officer. The passport may only be returned by the order of the court concerned. In case the applicant does not have passport, he shall give an undertaking to that effect to the Investigating Officer.
