This is an application under Section 483 of the Bharatiya Nagarik Suraksha Page No.# 2/3 Sanhita, 2023, for granting regular bail to the petitioner, Gauri Rajbongshi in respect of Bhangagarh P.S. Case No.32/2026, under Section 143(1)(f)/143(4) of the BNS, 2023 read with Section 75/79 of the Juvenile Justice (Care and Prohibition of Children) Act, 2015 and 14 (1) of Child Labour (Protection and Regulation) Act, 1986. 3. A 12-year-old girl was sent by her parents to the residence of the present petitioner on a condition that she would be paid Rs.3,000/- per month and provided with proper education. 4. Subsequently, the guardian of the girl lodged an FIR before Police stating that her whereabouts were unknown to her. Therefore, Mr. Ranjan Kumar Deka, the brother-in-law of the present petitioner handed over the girl to Police and the girl has already been taken away by her guardian. 5. I have considered the submissions made by the learned counsel of both sides. 6. The girl has been recovered and handed over to her guardian. Now, under the given circumstances, the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 7. It is hereby directed that in the event of arrest in connection with Bhangagarh P.S. Case No.32/2026, under Section 143(1)(f)/143(4) of the BNS, 2023 read with Section 75/79 of the Juvenile justice (Care and Prohibition of Children) Act, 2015 and 14 (1) of Child Labour (Protection and Regulation) Act, 1986 the petitioner, Gauri Rajbongshi shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati.
