Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue Writ of Mandamus declaring the inaction on the part of the respondents in recording the execution of the work and processing the bills payable to the petitioner for the works duly executed by the petitioner as arbitrary, illegal and well established legal principles apart from being violative of the fundamental and Constitutional rights guaranteed to me under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents complete all the formalities and pay the admitted amounts IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to take necessary action for payment of the admitted amount which the petitioner is entitled to, pending disposal of the above Writ Petition Counsel for the Petitioner:

The Court made the following Order:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the execution of the following works “Construction of CC Road from D.No.58/293-10-1 to D.No.58/293-14-1, 58/186, 58/36 to 58/44, 58/322-3 to 58/340-2, 58/384-8-5 to 58/384-5 and CC drain from D.No.58/293-10-1 to 58/293-14-1, 57/451-1 to 57/437, 58/223 to 58/228 and Culvert at D.No.58/374-5-19, 58/253-1-2 in Akkayapalli Village in 47th Division of Kadapa Municipal Corporation,” with an Estimated Cost of Rs.20 Lakhs. The said work has been identified based on the requirement raised by citizens in the locality and the resolution have passed based on the consensus reached among the GGMP Committee members and agreed to take up the above work as per G.O. Rt. No. 123, Dated: 30.12.2022, under GGMP Funds and that the petitioner has completed the works entrusted to him and submitted the M- Books and other necessary records for finalisation of the amounts due and payable to him. It is submitted that, however, respondent No.5 has so far not finalised the bills, though the works have been completed and the same were executed to the satisfaction of respondents Nos.4 and 5. 2. The learned Standing Counsel appearing for respondent No.4, on written instructions, submits that the works have been completed and the same have been recorded in the M-Books. It is further submitted that respondent No.5 is required to determine the amount due and payable to the petitioner and that the same could not be finalised as respondent No.4 has addressed the Principal Secretary to Government, Planning Department,

requesting release of funds towards the GGMP works executed by the petitioner. It is submitted that, soon after receipt of the funds from the Government, respondent No.4 shall release the eligible amount due and payable to the petitioner towards the GGMP works, subject to verification. 3. Recording the aforesaid submissions, the writ petition is disposed of directing respondents Nos.4 and 5 to finalise the amount payable to the petitioner and, upon due verification, release the amount due and payable to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed.
